Please understand that when you make agreement to pay a deposit or purchase for a puppy that you have agreed to the policies below for

Middle Creek Yorkies. It is the buyer responsibility to read these policies and adhere to them. Our sale contract will be given to you at time of sale with the terms and agreements and every buyer must agree to these guidelines before making a purchase with Middle Creek Yorkies.   1. This contract guarantee is for 72 hour health guarantee after pick up of the puppy (Excluding Sunday and Any Holidays). Every reasonable care has been take to insure the health of this animal. The buyer has the option, within 72 hours of receipt, to have this animal examined by a licensed  To activate the 5 business day health guarantee on new puppy the purchaser is required to take their puppy to a licensed Veterinarian for a health check up within (3) business days after picking up the new puppy. If the veterinarian finds any life threatening congenital defect or serious illness with the puppy, purchaser must notify seller immediately on same day. Seller will give purchaser a full refund of purchase price only with the return of the puppy with registration paper (if applicable) and providing a written statement from the veterinarian indicating the puppy illness and life threatening problem. We also offer a 365 day guarantee that if the puppy should die of a unknown (at time of sale) congenital birth defect, the dog will be replaced but only if an appropriate autopsy (at buyers expense) is performed by a licensed veterinarian and a veterinarians certificate is provided as proof of cause of death. The replacement will come from the next available litter matching the requirement of the first puppy.


  1. Failure to return puppy and statement as required within 3 days of purchase date, shall have the effect of fully and conclusively terminating any and every obligation or warranty of seller under this agreement and purchaser shall be deemed to have accept puppy “as is”. If the puppy is not taken to a licensed veterinarian within (3) business day, then the 3 day health agreement on the puppy is void.


  1. Seller is not responsible or guarantee for the puppy death due to accidents injury, neglect, hypoglycemia, dehydration, food poisoning or any other illnesses that could have been prevented by the purchaser.


  1. This guarantee will not cover any health problems that are not detected by a licensed veterinarian. Common problems internal and external parasites of any kind, such as fleas, mites, ticks, ringworm, giardian, and coccidia ( as both are proven to lie dormant and are brought on by external conditions such as stress, etc), proper bite, think coat, hernia of any kind, trachea problem, low blood sugar (Hypoglycemia), luxating patella, grade 1 heart murmur, minor physical flaws, or any condition that can be corrected over time or treat with veterinarian treatment. However preventative measures have been administered and all of these conditions (if present) have been treated for prior to sale of our pups. Seller does not guarantee color, the adult size, conformation, reproductive ability, testicles descending, potty training ability or the temperament of the puppy. The buyer assumes full responsibility for proper care once the puppy leaves the breeder. The buyer also assumes the responsibility of understanding the signs and treatment of hypoglycemia, a common problem with small breed puppies.


  1. The guarantee against transmissible diseases such as parvovirus, for example, is valid for a period of 7 days starting on the day of delivery, since the normal incubation period for transmissible disease is 5 to 7 business days. For example; if first signs of diseases, such as, parvovirus were to show up on puppy 12 or 15 days from delivery, the puppy could not have carried the disease form the breeder’s premises and incubated it for that long before showing signs of the disease.


  1. Yorkshire Terriers can dramatically change their color, size, weight and appearance as they grown and mature. Breeder can give an approximation as to size and color puppy is going to be when full grown but breeder gives no guarantee regarding size, weight, or color of said puppy. There is NO guarantee, written or implied, as to adult size of puppy, show potential, ear size or positioning, coat quality or temperament. This puppy is being sold as pet quality only, even when breeding rights are given. There is no guarantee against breeding soundness, sperm county/ quality, females coming into heat, or reproducing.







  1. The puppy has been on Science Diet Puppy Small Bites Dog Food since weaning. We highly recommend your puppy stays on this food until 10 months of age, then switching to the Adult Science Diet Small Breed Food. If switching food please use the following recommended ration as stated.


  1. The guarantee in this contract is valid for the original purchaser of puppy/dog only and is not transferable to third party. If purchaser sold puppy/ dog this contract is null and void.


  1. Seller will provide purchaser with up to date puppy vaccination and de-worming record. No puppy should leave the house or to public area until the full series of puppy shots have been completed this to insure the best possible immunity against communicable diseases.


  1. All deposits are non- refundable and the deposit will apply to purchaser final price. Puppy will be held until the balance is paid in full when the puppy is ready for their new home. Final payment must be completed by 12 weeks of age on puppy. If the puppy you selected put on deposit develop and issue prior to him/her leaving out care, purchaser will be notified and offered other puppy that's the same quality and price are comparable to what purchaser originally paid or replacement puppy on next coming litter. Upon payment in full of purchase price by buyer, seller agrees to release puppy to buyer. Seller will provide registration papers withing forty-five (45) days of sale date including all signatures necessary for registration.


  1. All sales are to be considered and initiated and finalized in Linn County, Kansas. If buyer should ever try to take seller to court, buyer is responsible for all costs incurred including seller’s attorney and the suit can only be filed in Linn county, Kansas.


  1. The breeder neither makes nor implies any warranties or guarantees or implied, other than those written in the agreement including, without limitation, the warranties of merchantability and fitness. This document constitutes the entire agreement between breeder/ seller and buyer with respect to this sale. The buyer’s signature below indicates that he/she has read, agreed to, and does understand all the conditions of sales of the agreement of contract of sale.
